1. Acceptance of Terms

By accessing or using AtmaNirbhar AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Atmanirbhar AI Consulting Private Limited (CIN U62099KA2026PTC222785), registered at 4053, Prestige Sunrise B4, N2 Electronic City, Electronic City, Bangalore South, Bengaluru – 560100, Karnataka, India(“we”, “us”, “our”).

2. Description of Service

AtmaNirbhar AI provides AI-powered conversational assistants delivered through WhatsApp and other messaging channels. The Service enables businesses (“Tenants”) to automate customer interactions including:

• Appointment booking and management
• Customer inquiry handling
• Payment processing
• Automated reminders and follow-ups

3. User Accounts

• Business accounts require valid registration through our onboarding process.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.

4. AI-Generated Content

• Responses generated by our AI assistant are for informational purposes and should not be considered professional advice (medical, legal, financial, or otherwise).
• We do not guarantee the accuracy, completeness, or reliability of AI-generated responses.
• Users should verify critical information independently before acting on AI responses.
• The AI may escalate conversations to human support when confidence is low or safety concerns are detected.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or bulk communications.
• Send WhatsApp, Instagram, or Messenger marketing messages without the recipient’s prior opt-in, or otherwise in breach of Meta’s Business Messaging Policies (including the 24-hour messaging window and template rules). As a Tenant you are the sender of record and are responsible for lawful consent and honouring opt-outs (e.g. “STOP”).
• Attempt to manipulate, exploit, or bypass AI safety features.
• Transmit illegal, harmful, threatening, or abusive content.
• Impersonate another person or entity.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse-engineer, decompile, or disassemble any part of the Service.

6. Pricing and Payment

• Pricing is as listed on our website and is subject to change with 30 days notice.
• Subscription fees are billed monthly in advance.
• Usage beyond plan limits may incur additional charges or service throttling.
• Fees are non-refundable except as set out in our Refund & Cancellation Policy.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described therein.

8. Service Availability

• We strive for high availability but do not guarantee uninterrupted service.
• We may perform scheduled maintenance with reasonable advance notice.
• We are not liable for any downtime or service interruptions beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, AtmaNirbhar AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

10. Termination

• You may cancel your subscription at any time through the dashboard.
• We reserve the right to suspend or terminate accounts that violate these terms.
• Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.

11. Governing Law

These terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
